C. Hierarchy of requirements
Currently within DOE there are two parallel
hierarchies of requirements:
Rules and/or regulations (these terms are
used interchangeably in this training)
DOE Orders
III. Rules and regulations
In response to the enforcement authority in the
Price-Anderson Amendments Act (PAAA) of 1988,
DOE is converting its contractual requirement in
orders to enforceable rules to enhance contractor
accountability for safety.
A. DOE enforcement of rules under PAAA
10 CFR Part 820 (effective on September 16,
1993) sets forth the procedures to implement the
provisions of the PAAA. Part 820 requires
contractors to comply with DOE Nuclear Safety
Requirements.
PAAA demands a "large stick" to enhance
contractor accountability for safety. Rules
provide authority for the assessment of civil and
criminal penalties and thus provide the large
stick.
