C. Relationship between 10 CFR Part 835 and the
DOE Radiological Control Standard
1. Compliance
The Office of Enforcement (HS - 40) will
enforce 10 CFR Part 835. It can assess
fines and penalties.
The Program Offices will audit for both
compliance with 10 CFR 835 and
contractual agreements including the DOE
Radiological Control Standard or Manual,
Orders, etc. Results of these audits can
affect the contractor's award fee.
2. What if there are conflicts?
10 CFR Part 835 takes precedence over
requirements of the DOE Radiological
Control Standard and orders. It is unlikely
that there will be a conflicting requirement
between the two documents, although one
document may have a requirement that is not
addressed in the other.
